To formalize the legal relationship between QuickPay and the owner of the Personal Data. To include you in our database, integrate files, either directly or through a third party. To process requests you make through our Electronic Means. To create your user profile on our App. To verify and investigate creditworthiness. To comply with customer knowledge (know your customer or KYC) and anti-money laundering provisions, either for QuickPay or its affiliates or subsidiaries, as provided by the respective legislation. By pressing the "Register" button on the Site, the User acknowledges and declares that they have read, understood, and fully accepted the content of the General Terms and Conditions in all its parts, agreeing to be governed by all its provisions, and being subject to applicable laws and regulations. Once the "Register" button is pressed, this instrument will be binding and obligate the parties. If the User does not accept the General Terms and Conditions, they will not be able to access, browse, and use the Site. Likewise, they will not be able to use its services or the information available on the web pages that make up the Services.
The Services are only available to individuals who have the legal capacity to contract (capacity to exercise) according to applicable laws and who meet the requirements established in the General Terms and Conditions. Consequently, persons without capacity and QuickPay Users who have been temporarily suspended or permanently disabled will not be able to use the Services. If the User is a legal person, their legal representative, who subscribes and accepts the General Terms and Conditions, declares that they have sufficient powers to act and contract on behalf of the Client and/or User and to bind them to the provisions contained in the General Terms and Conditions.
It is mandatory to complete the registration form in all its fields with valid personal data in order to use the Services provided by QuickPay. The User must complete it with accurate, precise, and truthful personal information (the "Personal Data"), assuming in any case the obligation to update the Personal Data as necessary. QuickPay may use various means to identify its Users. QuickPay is not responsible for the accuracy and veracity of the Personal Data provided by its Users. Users guarantee and respond, in any case, to the legality, veracity, accuracy, validity, and authenticity of the Personal Data entered. QuickPay reserves the right to request any proof and/or additional data in order to corroborate the Personal Data, as well as to temporarily or permanently suspend Users whose data could not be confirmed.
The User will access their account ("QuickPay Account") by entering their email address and chosen password ("Security Key"). The User is obligated to always keep the confidentiality of their Security Key. The User accepts and understands that the QuickPay Account is personal, unique, and non-transferable, and it is prohibited for the same User to register or possess more than one QuickPay Account. If QuickPay detects different QuickPay Accounts that contain matching or related data, it may, at its discretion, cancel, suspend, or disable them.
The User will be responsible for all operations carried out on their QuickPay Account, as access to it is restricted by entering and using their Security Key, which should be known only to the User. The User is obligated to immediately notify QuickPay and by suitable and reliable means, any unauthorized use of their QuickPay Account, as well as unauthorized access by third parties to it. It is clarified that the sale, assignment, or transfer of the QuickPay Account (including reputation and ratings) under any title is prohibited.
QuickPay reserves the right to reject any registration request or to cancel a previously accepted registration, without being obliged to communicate or explain the reasons for its decision, and without this generating any right to compensation or restitution.
To use the Services offered by QuickPay, the Client and/or User must provide certain personal and sensitive data. Your personal information is processed, treated, and stored on servers or magnetic media that maintain adequate security and protection standards both physically and technologically. For more information on the privacy of the Personal Data, you should review the Privacy Policies on the Site.
QuickPay may modify the General Terms and Conditions at any time by publishing the modified terms on the Site. All modified terms will take effect 10 (ten) days after their publication. Within 5 (five) days following the publication of the introduced modifications, the User must communicate via email if they do not accept them. In this case, the contractual bond between the parties will be dissolved, and the User who does not accept the modified terms will be disabled from the Site as long as they have no pending credits to pay to QuickPay. After this period, it will be considered that the User accepts the new terms, and the agreement will continue in effect for both parties.
This document will remain in effect as long as QuickPay keeps the Site in operation. QuickPay reserves the right to stop offering the Site and the Services provided through it at any time, with prior notice to Clients and/or Users.
No action or use of device, software, or other means aimed at interfering both in the activities and operation of QuickPay, as well as its database, is allowed. Any intrusion, attempt, or violation or contrary activity to the laws on intellectual property rights and/or the prohibitions stipulated in these General Terms and Conditions by the Client and/or User will make them liable for the pertinent legal actions and the sanctions provided for in this agreement, obligating them to pay compensation for the damages and prejudices caused.
In this regard, the Client may not:
Without prejudice to other measures, QuickPay may warn, temporarily suspend or permanently disable a Client and/or User's QuickPay Account or a publication, apply a penalty that negatively impacts a User's reputation, initiate actions it deems appropriate, and/or suspend the provision of its Services if:
The Client and/or User acknowledges and accepts that the use of the Site is their sole responsibility, and therefore releases QuickPay and its directors, managers, employees, agents, operators, representatives, and/or officers from any complaint, fine, complaint, demand, and/or action by any authority or third party, arising from the negligent, illegal, improper, and/or illicit use of the Site, reserving QuickPay's rights to claim compensation for the damages caused as a result, for the same concept.
The Site, the Services, and their processes, including but not limited to the associated and developed technologies, are the property of QuickPay, as are the trademarks, domain names, trade names, logos, commercial notices, slogans, designs, symbols, and any other intellectual property materials and copyrights related to QuickPay's Services (the "Intellectual and Industrial Property").
The General Terms and Conditions do not grant and should not be interpreted as granting any transfer, license, or authorization of QuickPay's Intellectual and Industrial Property rights. It is expressly prohibited to reproduce, commercialize, distribute, disseminate, or otherwise use the Intellectual and Industrial Property without QuickPay's express consent.
The Client and/or User agrees not to violate in any way QuickPay's Intellectual and Industrial Property rights, and to indemnify QuickPay, its shareholders, directors, managers, employees, and/or representatives for any violation of QuickPay's Intellectual and Industrial Property rights, committing to pay QuickPay any amount for damages, including legal expenses and attorney fees, incurred by QuickPay for any claim related to a violation of Intellectual and Industrial Property.
The General Terms and Conditions will be governed and interpreted in accordance with the applicable laws of the United Mexican States. Any controversy arising from this agreement, its existence, validity, interpretation, scope, or compliance, will be submitted to the applicable laws and to the competent Courts of Mexico City, and the proceedings will be conducted in Spanish.
